Summary of changes in this version. This update corrects our earlier statement that we do not sell or share personal information. Like many websites, we use advertising and analytics technologies that may count as a “sale” or “sharing” under California and other state laws, and this policy now discloses that and explains how to opt out. We also updated our list of service providers, clarified that the Service is web-based and has no mobile app, and confirmed that the Service is directed to users in the United States.
This Privacy Policy is effective as of the date above and applies to The Fresh 20, a service operated by Freshly, Inc. (“The Fresh 20,” “we,” “us,” or “our”).
Your privacy matters to us. We ask for personal information only when we need it to run the Service, we do not sell your personal information for money, and we share it only as described in this policy, including the advertising and analytics activity explained in Section 6. The sections below explain what we collect, why, who we share it with, and the choices and rights you have.
1. Scope of this policy
This policy applies to information we collect when you visit or use our websites, including thefresh20.com, members.thefresh20.com, and our checkout and funnel pages (together, the “Site”), and when you use our email lists, meal-plan and content subscriptions, and related features and communications (together, the “Services”).
This policy does not cover information collected by third parties through services or links that are accessible from the Site but operated by others. When you follow a link to another website, that site’s own privacy policy applies.
By using the Site or Services, you agree to this Privacy Policy. If you do not agree, please do not use the Site or Services.
2. Information we collect
Information you give us directly
When you opt in, create an account, make a purchase, enter a giveaway, respond to a survey, or contact us, we may collect your name, username, email address, mailing address, phone number, account password, and the details of your message or request. When you buy a product, your payment card details are collected and processed by our payment processors, not stored by us directly (see Section 5).
Information we collect automatically
When you use the Site, we and our service providers automatically collect:
- Usage information, such as the pages you view, the links you click, and how you interact with the Site.
- Device and log information, such as your browser type and version, operating system, device identifiers, referring and exit pages, and standard server-log data.
- Your Internet Protocol (IP) address. We use IP information for security, fraud prevention, and to enforce our one-household account rule described in our Terms and Conditions.
- Approximate location derived from your IP address. We do not collect precise geolocation data.
The Service is web-based and accessed through a browser. We do not operate a mobile app and do not collect GPS or app-based device data.
Information from third parties
If you connect a social or third-party login, that provider may share information with us, such as your user ID and any details you have permitted it to share. We may also receive information from our payment processors and from our analytics and advertising partners.
3. Cookies and tracking technologies
We and our service providers use cookies and similar technologies (such as pixels, tags, and web beacons) to keep you logged in, remember your preferences, personalize content, measure and improve the Service, and support our marketing and advertising.
We currently use, among others:
- Google Analytics and Google Tag Manager, to measure traffic and usage.
- A Meta (Facebook) pixel, to measure and support advertising.

You can set your browser to refuse some or all cookies or to alert you when one is sent. Some features of the Service may not work properly if cookies are disabled. You can also opt out of certain advertising cookies through industry tools such as the Digital Advertising Alliance and the Network Advertising Initiative opt-out pages, and through your device and browser settings.
Once our cookie preferences tool is live, you will be able to accept or reject non-essential cookies and change your choice at any time, and we will treat a recognized opt-out preference signal such as the Global Privacy Control as a request to opt out where required by law.
4. How we use information
We use the information we collect to:
- Provide, operate, and maintain the Service and your account.
- Process payments, deliver your products, and send transaction, billing, and renewal communications.
- Provide customer support and respond to your requests.
- Personalize and improve the Service.
- Send marketing emails, newsletters, promotions, and offers, where permitted.
- Measure and support advertising and analytics.
- Protect the security and integrity of the Service, prevent fraud, and enforce our Terms.
- Comply with legal obligations.
5. How we share information
We do not sell your personal information for money. We share it only in the ways described here.
Service providers
We share information with third parties that perform services for us, under contracts that require them to protect it. These currently include, among others:
- Payment processing: Stripe and PayPal.
- Checkout and order pages: FG Funnels.
- Customer support: Zendesk.
- Website and membership hosting: WordPress, including our members area at members.thefresh20.com.
- Analytics: Google (Google Analytics and Google Tag Manager).
- Advertising: Meta (Facebook and Instagram).
- Email marketing and newsletters: Flodesk.
- Email hosting: Rackspace.
Promotional partners
If you choose to take part in a joint promotion or giveaway, we may share the information needed to run it. Those partners have their own privacy practices, which we do not control.
Legal and safety
We may disclose information if required by law, subpoena, or valid legal request, or where we reasonably believe it is necessary to enforce our Terms, protect the security or integrity of the Service, or protect the rights, property, or safety of The Fresh 20, our users, or others.
Business transfers
If we are involved in a merger, acquisition, financing, reorganization, or sale of assets, your information may be transferred as part of that transaction, subject to the receiving party honoring this policy.
With your direction
If you connect a social media account or share content to a third-party platform, that sharing is governed by the third party’s policies. If you give another person access to your account, they may see your information.
6. Advertising, and “sale” or “sharing” under state law
We do not exchange your personal information for money. However, like many websites, we use advertising and analytics technologies (such as the Meta pixel and Google Analytics) that share certain identifiers and activity data with those providers to measure performance and show relevant ads. Under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, and under several other state laws, this kind of activity may be considered a “sale” or a “share” of personal information for cross-context behavioral advertising.
You have the right to opt out. Once our cookie preferences tool is live, you will be able to opt out in any of these ways:
- Use our cookie preferences tool and turn off the “Advertising and marketing” category.
- Browse with a recognized opt-out preference signal such as the Global Privacy Control enabled. We will treat a valid Global Privacy Control signal as a request to opt out where required by law.
- Email us at support@thefresh20.zendesk.com and ask to opt out of the sale or sharing of your personal information.
You can also use the Do Not Sell or Share My Personal Information page at any time.
We will not discriminate against you for exercising this right.
7. Your choices and rights
Marketing emails
You can unsubscribe from marketing emails at any time using the “unsubscribe” link in any such email, or by contacting us. You cannot opt out of service and transactional messages, such as account, purchase, billing, renewal, and security notices, because they are necessary to provide the Service. You may opt out of the weekly meal-plan delivery emails while keeping your subscription active.
California residents (CCPA, as amended by CPRA)
If you are a California resident, you have the right to:
- Know and access the categories and specific pieces of personal information we have collected, the sources, the purposes, and the categories of third parties we disclose it to.
- Delete personal information we have collected from you, subject to exceptions.
- Correct inaccurate personal information.
- Opt out of the sale or sharing of your personal information.
- Limit the use and disclosure of sensitive personal information, where applicable.
- Not be discriminated against for exercising your rights.
Categories of personal information we have collected in the past 12 months include identifiers (such as name, username, email address, mailing address, and phone number), internet and electronic activity information (such as browsing and usage data), commercial and financial information (such as purchase and billing records), and approximate location derived from IP address. We collect account log-in credentials, which some state laws treat as sensitive personal information. We use account log-in credentials only to operate and protect your account, and never for advertising or to build a profile of you, so the right to limit the use and disclosure of sensitive personal information does not apply.
To exercise your rights, contact us at support@thefresh20.zendesk.com. To protect your information, we will verify your identity before processing a request, which may require additional information. You may use an authorized agent, and we may require proof of the agent’s authority.
Other US state privacy rights
If you are a resident of another state with a consumer privacy law (for example, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and others), you may have similar rights to access, correct, delete, and obtain a portable copy of your personal information, and to opt out of targeted advertising and certain profiling. You may also have the right to appeal a decision on your request. To exercise these rights, contact us using the details in Section 13. If we deny your request, you may reply to our decision and ask us to reconsider, and we will respond within the time your state’s law allows.
EU, UK, and EEA residents
The Service is intended for and directed to users in the United States. We do not target or market the Service to individuals in the European Union, the United Kingdom, or the European Economic Area. See Section 10 for how we handle access from outside the United States.
8. Data retention
We keep personal information for as long as needed to provide the Service, maintain your account, comply with our legal and tax obligations, resolve disputes, and enforce our agreements. In general, we keep account information while your account is open and for a reasonable period after you close it, and we keep billing and tax records for as long as tax and accounting rules require. When information is no longer needed, we delete or de-identify it.
9. Data security
We use reasonable administrative, technical, and physical safeguards designed to protect your information, including the use of PCI-compliant payment processors for card data. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we learn of a security breach affecting your information, we will investigate and, where appropriate and required by law, notify you and take further steps.
10. International users and data transfers
The Fresh 20 is based in the United States, and the Service is intended for and directed to users in the United States. We do not target or market the Service to individuals in the European Union, the United Kingdom, or the European Economic Area.
If you choose to access the Service from outside the United States, you do so on your own initiative and you are responsible for compliance with your local laws. You understand that your information may be transferred to, stored in, and processed in the United States and in other countries where we or our service providers operate, and that these countries may have different data-protection rules than your own. Wherever your information is processed, we protect it in line with this Privacy Policy.
11. Children’s privacy
The Service is intended for adults. You must be at least 18 years old to register or purchase, and the Service and its content are not directed to children. We do not knowingly collect personal information from anyone under 18. Consistent with the Children’s Online Privacy Protection Act, if we learn that we have collected personal information from a child under 13 without verified parental consent, we will delete it promptly. If you believe a minor has provided us with information, contact us at support@thefresh20.zendesk.com.
12. Links to other sites
The Service may link to websites and services we do not operate. We are not responsible for their content or privacy practices. Review the privacy policy of any third-party site you visit. Information you post in public areas, forums, or social media connected to the Service is not confidential, and we may use it without restriction.
13. Changes to this policy and how to contact us
We may update this policy from time to time. When we do, we will revise the “Last updated” date above, and your continued use of the Service after a change means you accept the updated policy. For material changes, we will notify you by email. We encourage you to review this page periodically.
