Terms and Conditions

The Fresh 20 is a service operated by Freshly, Inc. (“The Fresh 20,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our websites, including thefresh20.com and its related subdomains, and the digital products and services we offer (together, the “Service”).

We believe in fair, plain, and honest dealing. Reading these Terms is your right and your responsibility. By visiting our websites, creating an account, or purchasing any product, you agree to these Terms. If you do not agree, please do not use the Service.

Who can use the Service

You must be at least 18 years old to create an account or purchase any product. By using the Service, you confirm that you are 18 or older and that the registration information you provide is accurate and complete. Failure to meet either requirement is a breach of these Terms.

Users and accounts

Users of the Service fall into three groups:

  • Visitors: unregistered users who browse the public site.
  • Opt-Ins: registered users who have created a free account or joined an email list.
  • Subscribers: paying customers with access to one or more products.

When you register, you create an account using your email address and a password, which together authenticate your access. You agree not to use another person’s name or identity, not to impersonate anyone, and not to use a name that we reasonably consider inappropriate.

You are responsible for all activity under your account and for keeping your password secure. Do not share your password. If you believe your account has been accessed without your permission, notify us right away at support@thefresh20.zendesk.com and change your password.

Our products

We sell fixed-price digital products only. There is no shipped food and no meal-kit delivery. Our products fall into two groups, and the group a product belongs to determines how billing and renewal work.

Subscription products (these renew automatically until you cancel):

  • Core Meal Plans: Classic, Paleo, Vegan, Gluten-Free, Vegetarian, and For One. Offered monthly, quarterly, or annual.
  • Mediterranean (Blue Zone) Meal Plan. Annual only.
  • All Access Pass, which includes all six Core plans. Annual only. The All Access Pass does not include the Mediterranean Meal Plan.
  • All Access Pass Plus, which includes all six Core plans and the Mediterranean Meal Plan. Annual.

One-time products (these do not renew and are not subscriptions):

  • Kitchen Passport, a one-time annual purchase that unlocks one country’s dinner-party experience each month and does not auto-renew. See the one-time products section below.
  • Lifetime Access, a single purchase that does not renew. Lifetime Access does not include Kitchen Passport.
  • Cooking Guides, E-Books, the Healthy Living Bundle, the Mind Body Reset Library, and Gift Certificates.

Product names, contents, and prices are described at the point of purchase and may change over time. The description and price shown to you during checkout govern that purchase. Current prices for each product are shown at checkout and on our pricing and plans page.

Prices, taxes, and the price-lock promise

All prices are shown in US Dollars and exclude applicable taxes unless stated otherwise. To the extent the law allows, you are responsible for any applicable taxes.

We may change our published prices at any time. For subscription products, the price you pay at signup is your permanent renewal price. We do not raise rates on an existing subscriber at renewal. The one exception is that any temporary discount, coupon, or promotional rate applies only as described at the time of the offer. If your subscription expires, lapses, or is canceled and you later return, the price then available will apply, which may differ from your earlier rate. Payment and payment processors

We use designated third-party, PCI-compliant payment platforms (for example, Stripe and PayPal) to process payments and to store card information. You are responsible for all transactions processed under your account, and you agree to keep a valid payment method on file. You can update your payment information at any time in your account dashboard. We are not liable for any loss or damage arising from errors or invalid transactions processed by a third-party payment platform.

Charges for an initial purchase are processed immediately at checkout, in line with the details shown to you during checkout.

Automatic renewal of subscription products

This section applies to subscription products only (Core Meal Plans, Mediterranean, All Access Pass, and All Access Pass Plus). It does not apply to one-time products.

Your subscription renews automatically

When you purchase a subscription, you authorize us, through our payment processor, to charge your payment method automatically at the end of each billing period (monthly, quarterly, or annual, depending on the term you chose) at your locked-in price, until you cancel. Renewal happens under the Terms in effect on the renewal date.

Reminder before renewal

Our payment processor sends a renewal reminder email before each renewal date. For annual subscriptions, we send this reminder at least 15 days before the renewal date. The reminder includes the renewal date and the last four digits of the card to be charged. The subject line reads, “Your The Fresh 20 / Freshly, Inc subscription will renew soon.” This reminder is your opportunity to cancel before the charge is made. It is your responsibility to keep your contact information current and to check your spam and promotions folders. We are not responsible for non-delivery by third-party email systems.

Failed payments

If a renewal charge does not succeed, we may retry the charge for up to 30 days.

One-time products and Kitchen Passport

One-time products are single purchases. They do not auto-renew and they are not subscriptions.

Kitchen Passport

Kitchen Passport is a one-time annual purchase. It does not auto-renew. Each country you unlock stays in your dashboard permanently. You own that content, and it remains accessible to you even if you do not purchase again the following year. Individual countries are available as standalone purchases only for the three evergreen countries (Italy, France, and Mexico) plus the country released during its release month. Once a released country’s month ends, it is no longer sold on its own, although everyone who already unlocked it keeps permanent access. If you buy the full annual program partway through the year, you receive immediate access to every country unlocked up to that point.

Lifetime Access

Lifetime Access is a single purchase with no recurring charge. It includes all seven meal plans (the six Core plans and Mediterranean) and the content described at purchase. Lifetime Access does not include Kitchen Passport.

Gift Certificates

Gift Certificates are one-time purchases that do not auto-renew. Gift certificates do not expire. They are not refundable, and they are not redeemable for cash except where the law requires. Any other terms specific to a gift certificate are as shown at the time of purchase.

Cancellation

You may cancel a subscription at any time, with no cancellation fee for canceling before a renewal date. To cancel, log in and go to Account, then My Account, then Cancel. If your account is billed through a payment processor portal, follow the instructions on your My Products page, which may direct you to manage the subscription through Stripe or PayPal.

To make sure your cancellation is processed before a renewal, cancel at least two business days before your renewal date. You cannot cancel by voicemail, email, or live chat alone. When you cancel, you keep access through the end of your current paid period. There is no prorated refund for canceling early. See the refunds section below.

One-time products do not need to be canceled, because they do not renew.

Refunds

Our refund policy is the same across products and is applied consistently to keep it fair to everyone.

First purchases

New purchases of any subscription or one-time product, other than gift certificates, carry a 7-day money-back guarantee. Request a refund within 7 days of your first purchase and we will refund you in full. After 7 days, no refund is available. Gift certificates are not refundable, as described in the one-time products section above.

Renewals

Renewal charges are generally non-refundable, because the renewal reminder gives you advance notice to cancel beforehand. As a goodwill exception, if you contact us within 7 days of a renewal date, we may issue a refund of that renewal charge minus a $5.00 USD administration fee, which covers card-processing costs. After 7 days from a renewal date, no refund is available.

Duplicate purchases

If you accidentally buy a duplicate subscription, we will cancel the duplicate and refund it in full with no fee.

Wrong product

If you buy the wrong plan, contact us within the 7-day window and we will process a refund and help you purchase the correct product.

Effect of a refund

When a refund is issued, your access to the related content is removed immediately, because the refund voids that purchase. Approved refunds are processed within 48 hours on our side. Depending on your bank, the funds may take up to ten days to appear.

Confirmed billing errors

Refunds for confirmed technical or billing errors on our side are handled outside the windows above.

Other than the goodwill exception described for renewals, the 7-day window is firm and there are no exceptions. Common questions about cancellation and refunds are also answered in our Frequently Asked Questions.

Access to content

You must have an active account to access subscription content. While your subscription is active, plans, shopping lists, prep guides, and recipe PDFs are available to view, download, and print. New weekly plans post to the members site each Friday.

Archive access is tied to an active subscription. Once a subscription expires, lapses, or is canceled, access to current and past plans ends until the account is renewed or reactivated. It is your responsibility to download or print any plans you wish to keep while your subscription is active. One-time products, such as Kitchen Passport content, Lifetime Access, e-books, and guides, remain in your account permanently regardless of subscription status.

One account per household, and account security

Each subscription is for one household. Content provided through your subscription is for your personal household use and may not be shared outside your household, except through any sharing features we expressly provide. Our system tracks IP usage and allows login from a single household (home and office are fine). A maximum of two devices may be used per account. If you reach the device limit, you may request a device reset from customer support.

We reserve the right to lock or cancel an account that shares passwords or copies or distributes content to another household, person, group, or platform. Our automated protection system may lock an account that shows excessive IP addresses. If an account is repeatedly locked for violations, the holder is not entitled to a refund.

Intellectual property

All content on the Service, including plans, recipes, guides, written material, and design, is original or licensed material and is protected by copyright and other intellectual property laws. It may not be copied, distributed, republished, or used elsewhere without our written permission. Photographs are original or licensed and may not be copied from the Service for use in a blog, article, or any other forum without our specific permission.

User contributions

If you post reviews, comments, photos, or other material to the Service (“User Contributions”), you are responsible for that content, and it must not be unlawful, infringing, abusive, or misleading. By posting, you grant The Fresh 20 a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with operating and promoting the Service. We may remove any User Contribution at our discretion, to the extent permitted by law.

Dietary, nutritional, and health disclaimer

The Fresh 20 provides recipes, meal plans, and related content for general informational purposes to help people cook real meals at home. We do not provide medical, nutritional, or dietary advice, and we do not diagnose, treat, or claim any specific health, weight, or medical outcome.

We do not guarantee the accuracy, completeness, or usefulness of any nutritional information, and we do not adopt or accept responsibility for it. You are responsible for confirming that the foods you and your household prepare and consume are appropriate for your own dietary needs, restrictions, and allergies. Always seek the advice of a physician or a registered dietitian about your own conditions and dietary needs. To the fullest extent permitted by law, The Fresh 20 is not responsible for any loss, illness, allergic reaction, or other harm resulting from your reliance on our content or from ingredients that are harmful to you or a member of your household.

Service availability and changes

We make reasonable efforts to keep the Service running, but technical issues or maintenance may cause temporary interruptions. To the extent the law allows, we may modify or discontinue features of the Service, temporarily or permanently, with or without notice, and without liability to you, except where prohibited by law. We have no obligation to maintain, support, upgrade, or update the Service or to provide any specific content, and we or the owners of any content may remove content without notice to the extent the law allows.

Termination

If we reasonably believe that you have breached these Terms or acted in a way inconsistent with them, we may suspend or terminate your account, and in that case you are not eligible for a refund. If we need to terminate your account for business or legal reasons unrelated to a breach by you, we will refund the unused, prepaid portion of your subscription on a prorated basis, and that refund is your sole and exclusive remedy for such a termination.

Disclaimer of warranties

EXCEPT AS OTHERWISE SPECIFICALLY PROVIDED HEREIN, YOUR USE OF THE SITE, THE CONTENT, AND ANY SERVICES OBTAINED THROUGH THE SITE IS AT YOUR OWN RISK. THE SITE, CONTENT, AND ANY SERVICES OBTAINED THROUGH THE SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER THE FRESH 20 NOR ANY PERSON ASSOCIATED WITH THE FRESH 20 MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SITE, CONTENT, OR SERVICES. WITHOUT LIMITING THE FOREGOING, NEITHER THE FRESH 20 NOR ANYONE ASSOCIATED WITH THE FRESH 20 REPRESENTS OR WARRANTS THAT THE SITE, CONTENT, OR ANY SERVICES OR OTHER ITEMS OBTAINED THROUGH THE SITE WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT THE SITE OR THE SERVER THAT MAKES IT AVAILABLE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SITE OR ANY CONTENT WILL MEET YOUR NEEDS OR EXPECTATIONS. TO THE FULLEST EXTENT PROVIDED BY LAW, THE FRESH 20 DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Limitation of liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL THE FRESH 20, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE, ANY LINKED WEBSITES, OR ANY CONTENT OR SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, AND LOSS OF DATA, WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

THE LIMITATION ABOVE DOES NOT APPLY TO LIABILITY RESULTING FROM OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, AND DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Indemnification

You agree to defend, indemnify, and hold harmless The Fresh 20, our affiliates, licensors, and service providers, and our and their respective officers, directors, employees, contractors, agents, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms, your User Contributions, your use of any content or services other than as expressly authorized, or your use of any information obtained from the Site.

Governing law and dispute resolution

The Site is operated from the United States. All matters arising out of or relating to these Terms are governed by the internal laws of the State of California, without regard to its conflict-of-law rules.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. For material changes, we will also notify subscribers by email. Material changes will take effect as described in the updated Terms. Your continued use of the Service after an update means you accept the revised Terms.

Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Additional terms

Additional terms may apply to specific features, products, or promotions. Where they do, those additional terms are incorporated into these Terms by reference. If a free trial, promotion, or other offer was made at the time of purchase, note any rules, conditions, cancellation dates, or price changes that apply when the trial or promotional period ends.

Assignment, waiver, severability, and entire agreement

We may assign or transfer our rights and obligations under these Terms. These Terms are personal to you, and you may not assign or transfer your rights or obligations without our written consent. There are no third-party beneficiaries to these Terms.

Our failure to enforce any provision is not a waiver of that provision or any other. If any provision is held invalid, illegal, or unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full effect.

These Terms, together with the Privacy Policy and any terms expressly referenced here, are the entire agreement between you and The Fresh 20, and they supersede any prior or contemporaneous understandings, except as we expressly provide otherwise.

The Fresh 20 respects the intellectual property rights of others and asks users of the Service to do the same. Under US copyright law, a recipe that is only a list of ingredients is not protected, but copyright may protect the description, explanation, or illustration that accompanies a recipe, and a collection of recipes such as a cookbook. If you believe content on the Service infringes your copyright, please contact our customer support team with the details.
